This website and online store are operated under the GetSwitches brand. Throughout the Site, the terms “GetSwitches,” “we,” “us,” and “our” refer to the business identified in Section 24 of these Terms of Service.
These Terms of Service (“Terms”) govern your access to and use of getswitches.com (the “Site”), including purchases made through the Site. By accessing the Site, placing an order, or using our services, you agree to these Terms and the policies incorporated into them.
If you do not agree to these Terms, you may not access the Site, place an order, or use our services.
1. Eligibility and Online Store Terms
By using the Site or placing an order, you represent that you are at least the age of majority in your state or jurisdiction of residence and have the legal capacity to enter into a binding agreement.
You may not use the Site or our products for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not violate applicable laws, electrical safety requirements, building codes, intellectual property rights, or the rights of another person.
You may not transmit malware, viruses, malicious code, or other material intended to interfere with the Site, our services, or another person’s systems.
2. Product Information
We make reasonable efforts to present product descriptions, measurements, specifications, finishes, materials, configurations, compatibility information, certifications, and images accurately. However, product photographs and digital renderings are provided for general reference, and colors or finishes may appear differently depending on lighting, photography, display settings, and screen calibration.
Many of our brass products are hand-finished. Natural and handcrafted variations in color, tone, texture, brushing, polishing, aging, machining, and patina are expected and are not considered manufacturing defects.
Unlacquered brass and other living finishes naturally change, darken, spot, tarnish, or develop patina through exposure to air, moisture, oils, cleaning products, and handling. These natural changes are inherent characteristics of the material and are not considered defects.
Product availability, materials, specifications, dimensions, components, prices, and configurations may change without notice. We may discontinue a product or configuration at any time.
3. Product Certifications and Listings
A certification, listing, or compliance mark applies only where it is expressly stated on the applicable product page and only to the specific product, electrical device, or component identified by that certification or listing.
Where a UL, cULus, or other certification relates to an internal electrical module or device, that certification does not automatically certify the decorative wall plate, finish, knob, external hardware, custom configuration, combined assembly, installation, or complete electrical system unless the applicable listing expressly states otherwise.
Decorative solid-brass plates and external hardware may be supplied together with separately certified electrical components, but this does not mean the decorative plate or complete assembled configuration is independently UL Listed or cULus Listed.
CE conformity is not the same as UL or cULus certification and may not satisfy local US or Canadian installation requirements.
Before purchasing or installing a product, the customer, installer, electrician, contractor, designer, or other responsible professional must confirm:
- The certification or listing required for the project.
- Whether the certification covers the relevant component or complete assembly.
- Applicable voltage, wattage, amperage, load, wiring, and circuit requirements.
- Compatibility with fixtures, bulbs, drivers, transformers, controls, and connected equipment.
- Acceptance by the applicable authority having jurisdiction, inspector, building department, or other regulatory authority.
Local approval requirements vary. Product availability on the Site does not guarantee approval for every project, jurisdiction, or application.
4. Orders and Order Acceptance
Submitting an order is an offer to purchase the products in your cart. All orders are subject to acceptance, payment authorization, product availability, fraud screening, and confirmation of configuration details.
An automated order acknowledgment does not necessarily mean that we have accepted the order. We may accept an order by sending an order confirmation, beginning production or fulfillment, or shipping the order.
We reserve the right, to the extent permitted by law, to refuse, limit, or cancel an order for reasons including:
- Suspected fraud, unauthorized activity, or payment risk.
- Incorrect pricing, product information, or configuration.
- Unavailable materials, products, or components.
- An address that cannot be served.
- Orders placed for resale without authorization.
- Errors affecting the Site, inventory, configurator, or checkout.
- Suspected violation of these Terms.
If we cancel an order after payment has been collected, we will refund the amount paid for the canceled item or order to the original payment method.
Customer Cancellation Requests
If you wish to cancel an order, contact us as soon as possible. A cancellation request is not guaranteed. Orders may enter production or fulfillment shortly after they are placed.
Customized, engraved, made-to-order, specialty-finish, and custom-configuration products may not be canceled after production or customization has begun, except where required by law. An order that has already shipped cannot be canceled and will instead be subject to the applicable Return and Refund Policy.
5. Prices, Payments, and Taxes
Unless otherwise stated, prices displayed on the Site are in US dollars. Applicable taxes, shipping charges, duties, or other charges will be displayed during checkout when available.
Prices and promotions may change without notice. A price change does not affect an order that we have already accepted, except when the displayed price resulted from an obvious error.
If we discover a material pricing or configuration error after an order is submitted, we may contact you for approval of the corrected amount or cancel the affected item and issue a refund.
You agree to provide current, complete, and accurate purchase, billing, shipping, and account information. You authorize us and our payment providers to charge the selected payment method for the total amount shown at checkout.
Payments are processed by third-party payment providers. We generally do not receive or store your complete payment card number.
6. Shipping and Delivery
Processing, production, shipping, and delivery times displayed on the Site are estimates unless expressly stated otherwise. Delivery dates are not guaranteed.
Delays may occur due to production requirements, order volume, material availability, carrier disruptions, customs processing, weather, incorrect addresses, inspection requirements, or other circumstances outside our reasonable control.
If we cannot ship within the time stated when you placed your order, we will provide a delay notice and, where required by applicable law, offer you the choice of consenting to the delay or canceling the unshipped portion of the order for a prompt refund.
Tracking information is provided when available. A carrier’s tracking estimate is controlled by the carrier and does not constitute a guaranteed delivery date from GetSwitches.
Please review our Shipping Policy for current handling times, delivery estimates, made-to-order timelines, tracking information, and rush-order conditions.
7. Shipping Addresses, Delivery, and Risk
You are responsible for providing a complete and accurate delivery address. Contact us immediately if you identify an address error. We cannot guarantee that an address can be changed after production or fulfillment begins.
We are not responsible for delays or failed delivery caused by an incorrect or incomplete address supplied by the customer.
If tracking indicates that a package was delivered but you cannot locate it, contact us and the carrier promptly. We will reasonably assist with an available carrier investigation, but a carrier’s confirmed delivery may be considered evidence of delivery unless applicable law provides otherwise.
Risk of loss and title pass as provided by applicable law. Nothing in these Terms limits rights that cannot legally be limited.
8. Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed by our Return and Refund Policy, which is incorporated into these Terms.
Return eligibility depends on the product, condition, timing, and reason for return. Certain products are non-returnable, including:
- Open-box items.
- Customized, engraved, and made-to-order products.
- Custom layouts, specialty finishes, and custom configurations.
- 3-gang, 4-gang, and 5-gang plates and other non-standard configurations.
- Unlacquered brass and unlacquered aged brass products.
- Knobs, handles, pulls, and door stoppers.
- Sample kits.
Non-returnable-item restrictions do not eliminate rights relating to verified manufacturing defects, an applicable written warranty, or rights that cannot be excluded under applicable law.
Products showing signs of use, installation, attempted installation, modified wiring, tool marks, removed screws, scratched or fingerprinted plates, bent terminals, missing components, or other damage may be refused for return as described in the Return and Refund Policy.
9. Dimmer and Lighting Compatibility
The customer is responsible for confirming compatibility between the selected dimmer and the applicable fixture, bulb, LED driver, transformer, power supply, circuit, and control system before purchasing or installing the product.
Different dimmer types are intended for different systems:
- TRIAC leading-edge dimmers are intended for compatible line-voltage loads, bulbs, and drivers identified as TRIAC or leading-edge dimmable.
- 0–10V dimmers require a compatible 0–10V driver and separate power arrangement.
- 12–24V DC strip dimmers require a compatible low-voltage DC power supply and load.
Using the wrong dimmer type may cause flickering, buzzing, limited dimming range, malfunction, or damage. Product availability or general compatibility information does not guarantee compatibility with every fixture, driver, bulb, or installation.
For larger projects, we recommend purchasing and testing one unit with the intended lighting system before ordering the full quantity.
10. Installation and Electrical Safety
Electrical products must be installed in accordance with all applicable local, state, and national electrical codes, manufacturer instructions, product ratings, permit requirements, and inspection requirements.
Electrical installation, replacement, testing, and troubleshooting should be performed by a qualified and appropriately licensed electrician.
The customer and installer are responsible for:
- Disconnecting and verifying power before installation.
- Confirming circuit type, wiring configuration, voltage, load, and compatibility.
- Following all instructions and applicable electrical codes.
- Obtaining required permits, inspections, and approvals.
- Confirming that the selected product is permitted for the intended location and use.
GetSwitches is not responsible for damage or injury caused by improper installation, incorrect wiring, incompatible equipment, overloading, unauthorized modification, misuse, failure to follow instructions, or work that does not comply with applicable electrical codes.
Nothing in these Terms excludes liability that cannot legally be excluded.
11. GetSwitches One-Year Limited Warranty
GetSwitches provides a one-year limited warranty against verified manufacturing defects in materials or workmanship. The warranty period begins on the date the product is delivered to the original purchaser unless a different written warranty period is expressly stated on the applicable product page.
Who and What Is Covered
This limited warranty applies to the original purchaser and covers products purchased directly from GetSwitches. It applies only when the product has been installed, used, and maintained in accordance with its instructions, ratings, and applicable electrical and building codes.
What Is Not Covered
This limited warranty does not cover:
- Normal wear and tear.
- Natural variations in handcrafted or hand-finished products.
- Natural patina, tarnishing, spotting, aging, or other expected finish changes.
- Damage caused by improper cleaning, chemicals, abrasives, moisture, or environmental exposure.
- Damage caused by improper installation, incorrect wiring, overloading, or non-compliant electrical work.
- Damage caused by incompatible bulbs, fixtures, drivers, transformers, power supplies, controls, or connected equipment.
- Misuse, abuse, accident, negligence, or use outside the product’s stated ratings.
- Damage caused by unauthorized modification, alteration, disassembly, or repair.
- Labor, removal, reinstallation, contractor, electrician, inspection, permit, finishing, or other third-party costs.
- Products purchased from an unauthorized reseller or other third party.
An exclusion applies only to the extent the excluded condition caused or contributed to the claimed failure.
How to Make a Warranty Claim
To request warranty service, email support@getswitches.com within the warranty period. Include your order number, a description of the problem, and clear photographs or video showing the product and claimed defect. We may request additional information or require the product to be returned for inspection.
For an approved warranty return, we will provide return instructions and, where applicable, a prepaid return label.
Available Remedy
If we confirm that a product has a covered manufacturing defect, we may, at our option:
- Repair the defective product.
- Replace it with the same or a reasonably equivalent product.
- Refund the purchase price paid for the defective product.
This remedy applies only to the defective product and does not include labor, removal, reinstallation, electrician, contractor, inspection, or other consequential costs, except where applicable law requires otherwise.
A repaired or replacement product remains covered for the remainder of the original warranty period or any longer period required by applicable law.
Implied Warranties and State-Law Rights
To the extent permitted by law, any implied warranty applicable to the product is limited to the duration of this one-year limited warranty. Some states do not allow limitations on the duration of an implied warranty, so this limitation may not apply to you.
This limited warranty gives you specific legal rights. You may also have other rights that vary from state to state.
12. Intellectual Property
All Site content—including text, photographs, graphics, logos, product imagery, renderings, videos, documentation, page layouts, software, designs, and other materials—is owned by or licensed to GetSwitches and is protected by applicable copyright, trademark, trade dress, design, database, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Site for lawful personal shopping purposes. No ownership rights are transferred to you.
Without prior written permission, you may not:
- Copy, reproduce, republish, distribute, sell, license, modify, or create derivative works from Site content.
- Scrape, crawl, harvest, download, index, or systematically extract Site content or data.
- Use Site content to create competing products, catalogs, configurators, datasets, renders, or services.
- Use Site content to train, develop, test, or improve an artificial-intelligence or machine-learning system.
- Remove copyright, trademark, attribution, watermark, metadata, or proprietary-rights notices.
- Circumvent access restrictions or technical protections.
Build Your Own Configurator
The interactive 3D product configurator—including its three-dimensional models, meshes, geometry, textures, materials, rendered previews, interface, visual presentation, configuration logic, data structure, animations, source code, and related assets—is proprietary to GetSwitches or its licensors.
You may not reproduce, extract, download, capture for commercial reuse, reverse engineer, decompile, modify, redistribute, imitate, or use any configurator asset or functionality to build or support another product, website, configurator, rendering service, or commercial offering.
Unauthorized use may result in legal action, including takedown notices under the Digital Millennium Copyright Act where applicable.
13. User-Submitted Content
You retain any ownership rights you hold in reviews, photographs, videos, comments, or other content you submit to GetSwitches.
By submitting content, you represent that:
- You own the content or have permission to submit it.
- The content does not infringe another person’s rights.
- The content is not unlawful, deceptive, defamatory, threatening, obscene, or malicious.
- Any statements about your experience are honest and accurate.
You grant GetSwitches a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, adapt, publish, display, and use the submitted content in connection with the Site, our products, customer support, and marketing, subject to applicable law and our Privacy Policy.
We may remove user-submitted content that violates these Terms or is otherwise inappropriate for the Site. We are not obligated to publish or retain submitted content.
Third parties may not copy or redistribute user-submitted content from the Site unless they have permission from the applicable rights holder.
14. Prohibited Uses
In addition to other restrictions in these Terms, you may not use the Site:
- For an unlawful, fraudulent, or deceptive purpose.
- To infringe intellectual property, privacy, publicity, or other rights.
- To submit false, misleading, or malicious information.
- To interfere with the security or operation of the Site.
- To introduce malware, malicious code, or harmful technology.
- To collect personal information about other users without authorization.
- To scrape, crawl, harvest, or systematically extract Site data or assets.
- To impersonate another person or misrepresent an affiliation.
- To bypass technical restrictions or security measures.
- To reproduce or commercially exploit the Site or its content without written permission.
15. Third-Party Services and Links
The Site may contain links to or integrations with services operated by third parties, including payment, shipping, reviews, social-media, analytics, and other providers.
We do not control and are not responsible for third-party websites, content, products, security, availability, or privacy practices. Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
16. Disclaimer of Site Availability
We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free. We may modify, suspend, restrict, or discontinue any part of the Site when reasonably necessary.
Information made available through the Site is provided for general product and purchasing purposes. It is not a substitute for project-specific advice from a licensed electrician, engineer, inspector, architect, or other qualified professional.
17. Limitation of Liability
To the fullest extent permitted by applicable law, GetSwitches and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of data, replacement labor, removal costs, reinstallation costs, or business interruption arising from or related to the Site, our services, or a product.
To the fullest extent permitted by law, our aggregate liability arising from a product or order will not exceed the amount you paid to GetSwitches for the specific product giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, or personal injury where applicable law prohibits such a limitation.
Some states do not allow certain exclusions or limitations of damages. In those states, these limitations apply only to the maximum extent permitted by law.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless GetSwitches and its owners, employees, contractors, service providers, and affiliates from third-party claims, losses, liabilities, damages, and reasonable expenses arising directly from:
- Your unlawful or unauthorized use of the Site or products.
- Your material violation of these Terms.
- Your infringement of another person’s rights.
- Content you submit to the Site.
This section does not require you to indemnify any party for that party’s own negligence, misconduct, defective product, or violation of law.
19. Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms.
20. Governing Law and Disputes
These Terms and any dispute arising from them are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law rules.
This choice of law does not deprive a consumer of any mandatory protection provided by the laws of the US state or jurisdiction that would otherwise apply and cannot legally be waived by contract.
Before commencing formal proceedings, you and GetSwitches agree to make a reasonable good-faith effort to resolve the dispute by written communication. To submit a dispute, contact support@getswitches.com and include your order number, a description of the issue, and the resolution requested.
If a dispute cannot be resolved informally, it may be brought before a court having lawful jurisdiction. Nothing in these Terms prevents either party from seeking urgent injunctive relief for misuse of intellectual property, confidential information, or unauthorized access to systems.
21. Termination
We may suspend or terminate access to the Site if you materially violate these Terms, use the Site unlawfully, threaten Site security, or infringe our rights or the rights of another person.
Termination of Site access does not affect rights, payment obligations, accepted orders, or liabilities that arose before termination. Provisions that by their nature should survive termination will remain effective.
22. Changes to These Terms
We may update these Terms to reflect changes in our services, business practices, or legal obligations. The revised version will be posted on this page with an updated “Last updated” date.
Changes will apply prospectively from the date they are posted and will not retroactively change the material terms governing an order already accepted, except where required by law or agreed by the customer.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.
23. General Provisions
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver of that provision or any other right.
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, asset transfer, or other lawful business transaction.
These Terms and the policies referenced in them constitute the entire agreement concerning your use of the Site and purchases from GetSwitches, except for any separate written agreement signed by an authorized representative.
Headings are included for convenience and do not affect interpretation.
